The U.S. Department of Labor’s final rule which updates and revises the “white-collar” overtime exemption regulations under the Fair Labor Standards Act became effective on January 1, 2020. Of particular note, the rule increases the minimum salary level for the exemption from $455 per week ($23,660 annually) to $684 ($35,568 annually) per week. In addition, the new rule permits employers to credit some non-salary payments toward the new minimum salary requirement.
